تعد الإشارات المذكورة بضمير المتكلم أو ما شابه في سياسة الخصوصية هذه إشارات إلى الموقع أو تطبيق جاك وتعد الإشارات "إليك" أو "المستخدم" إشارات إليك كفرد او شخص اعتباري، حسب مقتضى الحال.

تمثل هذه الشروط والأحكام اتفاقية "عقد" رسمية بين منصة الموقع أو تطبيق جاك والعملاء الذين يستخدمون منصة الموقع أو تطبيق جاك.

يشكل أي استخدام من جانبك للخدمات التي تقدمها منصة الموقع أو تطبيق جاك موافقتك على هذا العقد وأحكامه، وبناءً عليه يجب عليك - بعدم - استخدام منصة الموقع أو تطبيق جاك إذا كنت لا توافق على الشروط والأحكام الواردة في هذا العقد.

ما هي البيانات التي قد نجمعها منك.

قد نقوم بجمع ومعالجة البيانات التالية:

• البيانات التي تقدمها عن طريق تعبئة النماذج في الموقع أو تطبيق، بما في ذلك البيانات التي تم تقديمها عند التسجيل لاستخدام الموقع و التسجيلات المشتركة الأخرى على سبيل المثال تسجيلات دخول أو الاشتراك في خدماتنا أو نشر المواد أو طلب خدمات أخرى.
• البيانات التي تقدمها لنا، أو التي قد نجمعها منك، عندما تُبلغنا عن اي صعوبة تواجهها عند استخدام الموقع أو تطبيق.
• سجل المراسلات في حال الاتصال بنا.
• بيانات عامة ومُجمعة وديموغرافية وغير شخصية.
• إذا قمت بتحميل أو استخدام تطبيقنا للهاتف المتحرك، فقد نتمكن من الوصول إلى تفاصيل تتعلق بموقعك وموقع هاتفك المتحرك، بما في ذلك المُعرف المُميِّز الخاص بجهازك.
• تفاصيل المعاملات التي قمت بإجرائها عبر موقعنا أو تطبيق جاك وتفاصيل قيامنا بتجهيز وتسليم البضائع التي طلبتها.
• تفاصيل حول جهاز الكمبيوتر الخاص بك، بما في ذلك على سبيل المثال، عنوان بروتوكول الإنترنت IP الخاص بك ونظام التشغيل ونوع المتصفح، بالإضافة إلى البيانات المتعلقة باستخدامك العام لشبكة الإنترنت (على سبيل المثال: عن طريق استخدام تقنية تُخزن البيانات على جهازك أو الوصول إليه، مثل ملفات تعريف الارتباط وكود تتبع التحويلات وإشارات الويب وما إلى ذلك (المشار إليها مجتمعة بـ "ملفات تعريف الارتباط"
• عنوان بريدك الالكتروني و/أو رقم الهاتف الذي تم تزويدنا به من قبل الغير الذين أكدوا لنا استحصالهم على موافقتك على مشاركة عنوان بريدك الالكتروني.
• أي بيانات أخرى نعتبرها ضرورية لتعزيز تجربتك في استخدام الموقع.

 

كيف سنستخدم البيانات الخاصة بك:

قد نستخدم البيانات في الحالات التالية:

• لتزويدك بالمعلومات أو المنتجات أو الخدمات التي تطلبها منا أو نرى أنك قد تكون مهتماً بها، وحيث قمت بالموافقة على أن يتم الاتصال بك لمثل هذه الأغراض.

• لضمان تقديم محتوى موقعنا أو تطبيق جاك بأكثر الطرق فاعلية لك وللجهاز الذي تستخدمه للوصول إلى موقعنا أو تطبيق جاك.
• لأي سبب آخر نراه ضرورياً لتعزيز تجربة تصفحك للموقع أو تطبيق جاك.

 

إلى من يمكننا الإفصاح عن البيانات:

تُعد البيانات الخاصة بعملائنا جزءاً مهماً جداً من عملنا. وبالتالي فإننا لا نشارك البيانات إلا حسبما هو مذكور أدناه فقط ومع الشركات التي تتبع الممارسات التي لها مزايا حماية، وبحد أدنى، مماثلة لمزايا تلك الممارسات الواردة في سياسة الخصوصية:

• تحويلات الأعمال: في حالة الاستحواذ على شركتنا أو جميع أصولنا فعلياً، ستكون بيانات العميل أحد الأصول التي يتم تحويلها للمالك الجديد.

 

• حماية موقعنا والمواقع الأخرى: نفصح عن حساب العميل وبياناته الشخصية الأخرى عندما نرى أن هذا الإفصاح مناسب للامتثال للقوانين والتحقيقات التي تتم لإنفاذ القوانين ولحماية الحقوق أو الممتلكات أو سلامة مستخدمينا أو الآخرين. ويتضمن هذا تبادل البيانات مع الشركات والمؤسسات الأخرى لعدة أسباب، منها الحماية من جرائم الاحتيال والحد من مخاطر الائتمان.

 

كيف نُخزن البيانات الخاصة بك.

إننا نتخذ الخطوات اللازمة من الناحية التقنية، التجارية، الفنية، والإدارية لضمان التعامل مع البيانات بأمان وبما يتماشى مع سياسة الخصوصية، وذلك لحماية البيانات من الوصول إليها بشكل غير مصرح به، أو تغييرها، أو الإفصاح عنها أو إتلافها. ومن الممكن أن نستخدم -على سبيل المثال- تقنية إلكترونية مشفرة لحماية البيانات أثناء إرسالها إلى موقعنا، بالإضافة إلى جدار حماية إلكتروني خارجي، وتقنية جدار حماية إلكتروني على الكمبيوتر المضيف لموقعنا أو تطبيق جاك حتى نتمكن من صد الهجمات الضارة على الشبكة. سوف يتم السماح فقط للموظفين ومزودي الخدمات والوكلاء الذين يكون عليهم معرفة البيانات بالوصول إليها بغية تنفيذ عملهم.

ومن المهم بالنسبة لك التأكد من حماية كلمة المرور الخاصة بك والجهاز الذي تستخدمه للوصول إلى موقعنا لتفادي إي وصول غير مصرح به من الغير. وتتحمل أنت وحدك مسؤولية الحفاظ على كلمة المرور الخاصة بك في سرية تامة، على سبيل المثال، تأكد من تسجيل الخروج بعد الانتهاء من استخدام أحد الأجهزة ذات الاستخدام المشترك.

• بيانات التعريف الشخصي بما في ذلك، الاسم والبريد الإلكتروني وكلمة المرور والمراسلات وتفضيلات الإعلانات الشخصية.
• إعدادات الدفع بما في ذلك معلومات بطاقة الائتمان.
• إعدادات إشعارات البريد الإلكتروني.

يمكنك رفض تلقي رسائلنا التسويقية في المستقبل في أي وقت عن طريق ضبط تفضيلات مراسلات العميل الخاصة بك، من خلال رابط إلغاء الاشتراك الموجود في مراسلات البريد الإلكتروني. للتسوق من خلال تطبيق الهاتف الذكي ستحتاج إلى ضبط إعدادات الإشعارات في القسم العام في هاتفك الذكي.

بالإضافة إلى ذلك، سيضع النظام الخاص بنا ملفات تعريف الارتباط عند تسجيل الدخول إلى الموقع أو تطبيق جاك وهذا لضمان تجربة ممتعة وسلسة للمستخدم عبر الموقع أو تطبيق جاك. يمكنك إلغاء تفعيل ملفات تعريف الارتباط عن طريق تغيير إعدادات المتصفح أو إعدادات تطبيق جاك. وفي حال إلغاء التفعيل لملفات تعريف الارتباط، سيؤثر ذلك على كيفية عمل موقعنا أو تطبيق جاك وربما لن تكون قادراً على الوصول إلى أو استخدام بعض أو جميع الوظائف في الموقع أو تطبيق جاك. على سبيل المثال: تجمع ملفات تعريف الارتباط الخاصة بالأداء معلومات حول كيفية استخدامك للموقع أو تطبيق جاك –أي: الصفحات التي تزورها في معظم الأوقات- مما يسمح لنا بتزويدك بالخيارات المستهدفة وذات الصلة التي تعزز تجربة تصفحك واستخدامك للموقع أو تطبيق جاك.

يجوز أن نحتفظ بنسخة من البيانات لأغراض الامتثال للقوانين، وبالذات عند تحديثك للمعلومات حيث نحتفظ بنسخة من البيانات السابقة للحفظ في سجلاتنا.

 

ماذا لو غيرنا سياسة الخصوصية الخاصة بنا.

التعهدات والضمانات:

أنت تقر ب:

• الالتزام بكافة القوانين والأنظمة المعمول بها في المملكة العربية السعودية.
• تزويد الموقع أو تطبيق جاك بالمعلومات الدقيقة و تحديثها بشكل دوري.
• مراجعة أي إشعارات يتم إرسالها عبر الموقع أو تطبيق جاك والامتثال لها فيما يتعلق باستخدامك للخدمات التي تقدمها منصة الموقع أو تطبيق جاك.
• لن تستخدم الخدمة أو النظام الأساسي لإحداث ضرر أو مضايقة أو إزعاج لأي شخص.
• أنت توافق على تبادل المعلومات بين الشركات داخل منصة الموقع أو تطبيق جاك فيما يتعلق بعملياتك المنفذة وتقييم المعاملات معك.
• لن تعيق التشغيل السليم لمنصة الموقع أو تطبيق جاك.
• لن تحاول الإضرار بالخدمة أو النظام الأساسي بأي شكل من الأشكال.
• لن تقوم بنسخ أو توزيع النظام الأساسي أو أي محتوى آخر دون الحصول على إذن كتابي من الموقع أو تطبيق جاك.
• سنحتفظ بحسابك أو أي طريقة تعريف توفرها لك وتوفر الوصول إلى حسابك بطريقة آمنة وسرية.
• سوف تزودنا بجميع أدلة هويتك الخاصة بك وفقًا لتقدير الموقع أو تطبيق جاك.
• يحق لـ الموقع أو تطبيق جاك رفض تقديم الخدمة أو استخدام المنصة دون إبداء الأسباب.

 

نطاق الترخيص:

يمنحك الموقع أو تطبيق جاك ترخيصًا غير حصري وغير قابل للتحويل وغير قابل للترخيص من الباطن وغير قابل للإلغاء للحصول على خدماتنا واستخدامها فقط للأغراض الشخصية (ليس لأي أغراض تجارية بما في ذلك على سبيل المثال لا الحصر) وفقًا لهذا العقد، لذلك يجب عليك:

• عدم تقديم الخدمات أو الإيجار أو التأجير أو التخصيص أو إعادة البيع أو التوزيع أو الترخيص الفرعي لهذه الخدمات لأي طرف ثالث.
• عدم تعديل أو تقسيم أو ترجمة أو تلخيص أو إنشاء عمل فرعي يعتمد على فك التشفير أو تنفيذ الهندسة العكسية لتصميم منصة الموقع أو تطبيق جاك أو غير ذلك من تحديد أو محاولة تحديد أو محاولة الوصول إلى رمز المصدر أو التصميم الداخلي للخدمات أو أي نص أو صور وسائط متعددة (صور أو ملفات) أو بيانات أو معلومات أخرى يقدمها الموقع أو تطبيق جاك أو موفرو خدمات الطرف الثالث.
• عدم حذف أو تغيير أو أي تعديل آخر لأي حقوق نشر أو إخطارات رسمية أخرى واردة في الخدمات.
• عدم نقل الخدمات أو توزيعها عمدًا أو السماح بتنزيل الخدمات لاستخدامها بخلاف ما هو محدد هنا.
• عدم السماح بمشاركة اسم المستخدم / كلمة المرور أو بيانات الاعتماد الأخرى لخدمات الموقع أو تطبيق جاك.

 

الشروط والأحكام:

تحدد هذه الشروط والأحكام القواعد واللوائح لاستخدام تطبيقنا الإلكتروني وخدماتنا. من خلال الوصول إلى تطبيق جاك، نفترض أنك تقبل هذه الشروط والأحكام. لا تستمر في استخدام تطبيق جاك إذا لم توافق على جميع الشروط والأحكام المذكورة على هذه الصفحة.
حقوق الملكية الفكرية: ما لم يُنص على خلاف ذلك، يمتلك [جاك] و/أو ممن يملكونها حقوق الملكية الفكرية لجميع المواد على تطبيقنا الإلكتروني. جميع حقوق الملكية الفكرية محفوظة. يمكنك الوصول إلى هذا من جاك للاستخدام الشخصي الخاص بك بشرط أن تكون هناك قيود محددة في هذه الشروط والأحكام.

القيود: يُمنعك تحديدًا من كل مما يلي:

• نشر أي مواد من التطبيق على أي وسائط أخرى، أو برامج وسائل التواصل الاجتماعي، أو مواقع البيع الإلكترونية وغيرها.

• بيع، أو منح ترخيص فرعي، و/أو التجارة بأي مواد من التطبيق.

• أداء أو عرض أي مواد من التطبيق علنًا.

• استخدام جاك بأي طريقة قد تكون مدمرة للتطبيق.

• استخدام جاك بأي طريقة قد تؤثر على وصول المستخدمين إلى التطبيق.

الخصوصية: يُخضع استخدامك لتطبيقنا الإلكتروني أيضًا لسياسة الخصوصية الخاصة بنا. يرجى مراجعة سياسة الخصوصية الخاصة بنا التي تحكم استخدام المعلومات الشخصية التي تقدمها.

الحد من المسؤولية: في أي حالة من الأحوال، لا يُعتبر جاك, أو أي من موظفيها، أو مدرائها مسؤولين عن أي شيء ينشأ عن أو يتصل باستخدامك لهذا التطبيق الإلكتروني، سواء كانت هذه المسؤولية بموجب عقد. لن يتحمل جاك, بما في ذلك موظفيها ومدرائها، أي مسؤولية غير مباشرة، أو نتائج، أو مسؤولية خاصة تنشأ عن أو تتعلق بأي طريقة تتصل بك بالتطبيق.

القانون الساري والاختصاص القضائي: ستكون هذه الشروط خاضعة للقوانين والتفسيرات الصادرة منها في المملكة العربية السعودية, وتخضع للاختصاص القضائي غير الحصري للمحاكم الحكومية لحل أي نزاعات.

التغييرات: نحتفظ بالحق، بتقديرنا الوحيد، في تعديل أو استبدال هذه الشروط في أي وقت. إذا كانت المراجعة مهمة، سنحاول تقديم إشعار قبل 30 يومًا على الأقل قبل أي شروط جديدة تأخذ مفعولًا. ما يشكل تغييرًا مهمًا سيتم تحديده وفقًا لتقديرنا الوحيد.

من خلال الوصول أو استخدام جاك, فإنك توافق على الالتزام بشروط وأحكام هذه الاتفاقية. إذا لم توافق على الالتزام بالشروط والأحكام، يجب عليك عدم استخدام جاك

 

سياسة الضمان:

• تتعامل جاك مع قطع غيار السيارات الأصلية، وقطع الغيار البديلة المعتمدة فقط.
• يستند ضمان متجر جاك الإلكتروني على ضمان الوكيل أو الموزع المعتمد للقطعة، وتختلف مدة الضمان وآليته حسب نوع القطعة وتصنيفها وموردها، بما يتلاءم مع شروط وزارة التجارة والصناعة في المملكة العربية السعودية.
• جميع القطع التي تباع في الموقع قطع جديدة وغير مستخدمة، وتتبع جاك إجراءات فحص لكل قطعة مباعة للتأكد من ملاءمتها وجودتها.
• في حال ادعاء خلل مصنعي في القطعة، يتوجب على العميل تقديم ما يثبت وجود الخلل المصنعي، وعندها سيتم التنسيق معه لإجراءات الإرجاع أو الاستبدال بعد التأكد من الخلل.
• يكون الضمان ساري في حال تم التركيب بالوكالة أو الورش المعتمدة لدى جاك.

 

سياسة المطابقة:

تسعى جاك لأن يكون اختيار القطعة مطابقاً للمركبة، من خلال:

• تحديد المركبة والمعلومات اللازمة من قبل العميل كـ VIN number.
• اختيار القطع المتوافقة معها من المتجر.

(لذلك يتوجب على العميل تزويدنا بجميع البيانات الصحيحة للمركبة، لضمان توفير القطع المناسبة)

 

سياسة إلغاء الضمان:

يُستثنى من الضمان الحالات التالية:

• انتهاء مدة الضمان المحددة، أسبوعين من تاريخ الشراء.
• لا يحق فتح القطعة وتبديل مكوناتها أو أجزائها أو العبث بها وفي حال تم ذلك فإن الضمان يعتبر لاغي.
• لا يشمل الضمان الاستخدام أو التركيب الخاطئ أو البرمجة غير الصحيحة، وفي حال حصول أي ضرر بالقطعة من جراء التركيب يعتبر الضمان لاغي.
• يشمل الضمان القطعة التي لا تعمل بالشكل المطلوب، ولا يشمل اختلاف شكل أو مواصفات القطعة بسبب الطلب الخاطئ من قِبل العميل.

 

 

سياسة إلغاء الطلبات:
في جاك, نحن نفهم أن قد تحدث ظروف تستدعي إلغاء الطلبات. نحن نسعى لجعل هذه العملية مبسطة قدر الإمكان مع الحفاظ على العدالة لكل من عملائنا وعملياتنا التجارية. يرجى مراجعة الإرشادات التالية بشأن إلغاء الطلبات:


فترة الإلغاء: يمكن للعملاء إلغاء طلبهم بشرط أن لم يتم شحنه بالفعل.


كيفية الإلغاء: لإلغاء طلبك، يرجى التواصل بفريق خدمة العملاء لدينا عن طريق الواتساب. يرجى الاحتفاظ برقم الطلب الخاص بك لخدمة أسرع.


استرداد الأموال: إذا كان طلبك مؤهلاً للإلغاء خلال الفترة المحددة، سنقوم بإصدار استرداد للمبلغ مخصوما منه ٥٪؜ رسوم إلغاء إلى طريقة الدفع الأصلية المستخدمة للشراء. قد تستغرق عملية الاسترداد ٧ أيام عمل للمعالجة.


العناصر غير القابلة للإلغاء: قد لا تكون بعض العناصر مؤهلة للإلغاء، خاصة إذا كانت قابلة للتلف أو القطع الإلكترونية والقطع الكهربائية. يرجى التحقق من وصف المنتج أو الاتصال بنا للتوضيح قبل تقديم الطلب.

تغييرات الطلب: بمجرد معالجة الطلب أو شحنه، لا يمكن إلغاؤه. ومع ذلك، قد تكون تغييرات في الطلب ما زالت ممكنة. يرجى الاتصال بنا على الفور إذا كنت بحاجة لتعديل طلبك.


الاستثناءات: في بعض الحالات، مثل الظروف الاستثنائية أو الأحداث القوة القاهرة، قد ننظر في استثناءات لسياسة الإلغاء لدينا. يرجى الاتصال بنا مباشرة لمناقشة وضعك.

Limitation of liability: In no event shall Jaak, its employees, or its managers be liable for anything arising out of or related to your use of this electronic application, whether this liability is under contract. Governing law and jurisdiction: These terms shall be governed by and construed in accordance with the laws and interpretations thereof in the Kingdom of Saudi Arabia and subject to the non-exclusive jurisdiction of the government courts to resolve any disputes.

Changes: We reserve the right, at our sole discretion, to modify or replace these terms at any time. If a revision is material, we will try to provide notice at least 30 days in advance of any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By accessing or using Jaak, you agree to comply with the terms and conditions of this agreement. If you do not agree to comply with the terms and conditions, you must not use Jaak.

 

Warranty Policy: Jaak deals with original car parts and approved replacement parts only.

The warranty for Jaak’s online store is based on the warranty provided by the authorized agent or distributor for the part. The duration and mechanism of the warranty vary depending on the type, classification, and source of the part, in accordance with the terms of the Ministry of Commerce and Industry in the Kingdom of Saudi Arabia.

All parts sold on the website are new and unused, and Jaak follows inspection procedures for each sold part to ensure its suitability and quality.

In case of a claimed manufacturing defect in the part, the customer must provide evidence of the defect’s existence. After confirming the defect, coordination will be made for return or replacement.

The warranty is valid if the installation is done at the agency or workshops approved by Jaak.

Matching Policy: Jaak aims to ensure that the part selection matches the vehicle by:

Identifying the vehicle and necessary information from the customer, such as the VIN number.

Choosing parts compatible with the vehicle from the store. (Therefore, the customer must provide accurate vehicle data to ensure the availability of suitable parts.)

Cancellation of Warranty Policy: 

The following cases are excluded from the warranty:

Expiry of the specified warranty period, which is two weeks from the date of purchase.

Unauthorized opening of the part, replacement of its components or parts, or tampering with it; in such cases, the warranty is considered void.

The warranty does not cover incorrect use, improper installation, or incorrect programming. If any damage occurs to the part due to installation, the warranty is void.

The warranty covers parts that do not function as required but does not include differences in appearance or specifications due to incorrect customer orders

 

Order Cancellation Policy: 

At Jaak, we understand that circumstances may require order cancellations. We strive to make this process as straightforward as possible while maintaining fairness for both our customers and business operations. Please review the following guidelines regarding order cancellations:

Cancellation Period: Customers can cancel their order as long as it has not already been shipped.

How to Cancel: To cancel your order, please contact our customer service team via WhatsApp. Please have your order number ready for faster service.

Refunds: If your order qualifies for cancellation within the specified period, we will issue a refund deducted by a 5% cancellation fee to the original payment method used for the purchase. The refund process may take up to 7 business days to process.
